Description
The issue of granting an extension of the retirement age was discussed at recent SEC meetings. The discussion centered around the reported successful application of one of our field-based members. The SEC agreed that careful consideration be given to all elements of recent developments before the Union takes a test case on behalf of our members.
In making this decision we are mindful of the potential changes to legislation and the likelihood of success or not in doing so but the Executive is of the view that we should seek clarity on the question of extensions one way or another.
You may be aware of a previous case that was heard in the Workplace Relations Commission (WRC). The office-based staff member was successful, based on specific grounds. The Company indicated its intention to appeal against the decision. We awaited the outcome of this appeal that would help shape our strategy, however, the Company decided not to proceed with the appeal.
We are now requesting Branches to review their outstanding cases and forward the ones they feel have greatest potential to succeed at a third party. It may take up to six months before the WRC will convene a hearing. Therefore, Branches must factor this into their selection also, as well as the six-month deadline for submitting a claim i.e. anyone who has failed to secure an extension has to lodge a claim within 6 months.
We are supporting our members’ right to seek an extension to their retirement age. As you know there are agreements in place that outline the process and guidelines on how this is to take place. The Company must consider requests and prove “objective justification” on any refusals under several headings. Where we disagree with the Company, we need a strong case to challenge the Company’s position. The email should contain the member’s name, staff number, contact details, date of expected retirement and job role and any supporting documentation (including emails sent or received) requesting an extension.
